Company Identification Number (IČO): 87382440
Registered Address: Na Výsluní 464, 561 64 Jablonné nad Orlicí, Czech Republic

Hereinafter referred to as the "Seller".

These Terms and Conditions apply to purchase agreements concluded between the Seller and customers through the online store, subject to applicable Czech and European Union legislation.

1. General Provisions

1.1. By placing an order through the online store, the Buyer agrees to purchase the selected products under the terms specified during checkout and in these Terms and Conditions.

1.2. The Seller undertakes to deliver the ordered products, and the Buyer undertakes to pay the agreed purchase price and any applicable delivery charges.

1.3. Ownership of the products transfers to the Buyer once the purchase price has been paid in full and the products have been delivered.

1.4. These Terms and Conditions do not limit any mandatory consumer rights granted by applicable law.

2. Orders and Contract Formation

2.1. Products may be ordered through the online store at www.cappali.com.

2.2. Before submitting an order, the Buyer can review and correct the selected products, quantities, delivery details and payment information.

2.3. After placing an order, the Buyer receives an automated order confirmation by email.

2.4. The purchase agreement is concluded when the Seller accepts the order. An automated acknowledgement of receipt does not necessarily constitute acceptance.

2.5. The Seller may reject an order before its acceptance in justified circumstances, including product unavailability, incorrect order information or reasonable suspicion of fraudulent activity.

2.6. If payment has already been received for an order that is not accepted, the Seller will refund the payment without undue delay.

3. Prices, VAT and Payment

3.1. All product prices are displayed in the currency selected or available in the online store.

3.2. The Seller is not registered as a VAT payer in the Czech Republic. Therefore, Czech VAT (DPH) is not charged or separately stated in the product prices.

3.3. The displayed product prices are the final prices charged by the Seller for the products, excluding any separately stated shipping charges and any additional amounts that may legally apply to international deliveries.

3.4. Shipping costs and other applicable charges collected by the Seller are displayed before the Buyer confirms the order.

3.5. The Buyer can select from the payment methods available during checkout, including payment cards and other supported payment services.

3.6. Payment is generally required in advance unless another payment arrangement is expressly offered.

3.7. For international orders, customs duties, import taxes or other charges imposed by the destination country may apply. Such charges are borne by the Buyer unless otherwise stated or required by applicable law.

4. Delivery and Shipping

4.1. Products are delivered using the shipping methods available during checkout.

4.2. Delivery times depend on product availability, destination and the selected shipping method.

4.3. Any estimated delivery date displayed in the online store is indicative unless expressly agreed as a binding delivery deadline.

4.4. The Seller will deliver the goods without undue delay and within the period required by applicable law, unless the parties agree otherwise.

4.5. The Buyer is encouraged to inspect the shipment upon receipt and notify the Seller promptly of visible damage or missing items. Failure to do so does not affect the Buyer's statutory consumer rights.

4.6. Failure to accept a shipment does not, by itself, constitute withdrawal from the purchase agreement.

5. Right of Withdrawal and Returns

5.1. A Buyer acting as a consumer generally has the right to withdraw from a distance purchase agreement within 14 days of receiving the goods, without giving any reason.

5.2. For orders containing several goods delivered separately, the withdrawal period generally begins upon receipt of the last item.

5.3. To exercise the right of withdrawal, the Buyer must inform the Seller through an unequivocal statement sent to:

cappali@cappali.com

Alternatively, the Buyer may send written notice to the Seller's registered address.

5.4. The Buyer must return the goods without undue delay and no later than 14 days after notifying the Seller of the withdrawal.

5.5. Products should be securely packaged to prevent damage during return shipping. Original packaging is recommended but is not a mandatory condition for exercising the statutory right of withdrawal.

5.6. The Buyer bears the direct costs of returning the goods unless the Seller has agreed otherwise or applicable law requires otherwise.

5.7. The Seller will refund payments received from the Buyer, including the initial standard delivery cost up to the price of the least expensive standard delivery option offered, within 14 days of receiving the withdrawal notice.

5.8. The Seller may withhold the refund until the returned goods are received or until the Buyer provides evidence that the goods have been dispatched, whichever occurs first.

5.9. Refunds will be made using the original payment method unless another method is expressly agreed.

5.10. The Buyer may be responsible for a reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

5.11. The statutory right of withdrawal may not apply to certain products, including goods made to the Buyer's individual specifications or clearly personalised for the Buyer, where the conditions of the applicable statutory exception are met.

5.12. These exceptions do not automatically apply merely because a product is handmade or produced after an order has been placed.

6. Complaints and Defective Products

6.1. The Seller is responsible for ensuring that products comply with the purchase agreement and applicable legal requirements.

6.2. Consumers may exercise their statutory rights in relation to defects that become apparent within two years of receiving the goods, subject to applicable law.

6.3. Complaints may be submitted by email to cappali@cappali.com, specifying the order number, a description of the defect and, where appropriate, supporting photographs.

6.4. Depending on the circumstances and applicable law, the Buyer may be entitled to repair, replacement, an appropriate price reduction or withdrawal from the purchase agreement.

6.5. Consumer complaints will be processed without undue delay and no later than 30 days from submission, unless a longer period is expressly agreed with the consumer in accordance with applicable law.

6.6. The Seller will provide confirmation of the complaint and inform the Buyer of its resolution as required by law.

6.7. Statutory rights relating to defective products are independent of any voluntary commercial guarantee.

7. Gift Cards

7.1. CAPPALI gift cards may be purchased and redeemed under the conditions displayed on the relevant product page.

7.2. Gift cards may be used to purchase eligible products through the CAPPALI online store.

7.3. The validity period and any specific redemption conditions are communicated when the gift card is purchased.

7.4. Unused balances are not redeemable for cash except where required by applicable law.

7.5. Consumers purchasing gift cards online retain any statutory withdrawal rights that apply to their purchase. These rights are not excluded by a general no-refund policy.

7.6. The treatment of gift cards that have already been redeemed or partially redeemed is subject to applicable law and the specific circumstances of the transaction.

8. Alternative Dispute Resolution

8.1. The Seller aims to resolve customer complaints directly and amicably.

8.2. If a consumer dispute arising from a purchase agreement cannot be resolved directly with the Seller, the consumer may seek alternative dispute resolution through the competent authority:

Czech Trade Inspection Authority (Česká obchodní inspekce)
Central Inspectorate – ADR Department
Gorazdova 1969/24
120 00 Prague 2
Czech Republic

Email: adr@coi.gov.cz
Website: https://coi.gov.cz/informace-o-adr/

8.3. The consumer may submit a request for alternative dispute resolution in accordance with the applicable legal requirements.

9. Applicable Law and Final Provisions

9.1. These Terms and Conditions are governed by the laws of the Czech Republic.

9.2. If the Buyer is a consumer residing in another country, this choice of law does not deprive the Buyer of mandatory consumer protections that apply under the relevant legislation.

9.3. The Seller reserves the right to update these Terms and Conditions. Any updated version will be published on the website.

9.4. Changes do not affect purchase agreements concluded before the updated conditions become effective.

9.5. If any provision is found to be invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.

9.6. These Terms and Conditions take effect on 30 October 2026.
